Status report stands filed.
Learned Deputy Advocate General, under instructions of ASI Des Raj, Police Station Padhar, submits that in the trial Court next date of hearing is fixed for 03.10.2020 for recording of two witnesses. He further submits that out of total nineteen witnesses, eleven witnesses have been examined and one witness has expired and two have been summoned for 03.10.2020 and remaining five witnesses are two Doctors, One Judicial Magistrate and two police officials.
At this stage, under instructions, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file afresh.
In my opinion, an accused has a right to file successive bail applications, as permissible under law, and no liberty of this Court is necessary for filing such bail application either in this Court or in the Court of Sessions Judge having jurisdiction to decide the same.
Accordingly, the application is dismissed as withdrawn.
