Status report has been filed wherein it is stated that trial is at the stage of evidence and for that purpose, case has been fixed for 23rd March, 2021 for recording the statements of witnesses.
At this stage, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file afresh after recording the statements of material witnesses. He has also requested to expedite the hearing in trial.
In my considered opinion, for filing successive bail application, at any stage, as permissible under law, does not require any permission from Court and petitioner may file such application in the Competent Court including this Court without permission of Court.
So far as the request of learned counsel for petitioner to expedite the trial is concerned, it would suffice to say that trial shall not be lingered on unnecessarily and shall be completed by managing the trial in terms of H.P. High Court of Himachal Pradesh Case Flow Management (Subordinate Courts), Rules, 2005.
Accordingly, the petition is dismissed as withdrawn, as prayed.
