Status report stands filed.
Learned Deputy Advocate General, as per instructions received, submits that fourteen witnesses have been examined and for examining remaining eleven witnesses, case has been fixed w.e.f. 30.10.2020, 31.10.2020 and 02.11.2020.
At this stage, under instructions, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file afresh and also with a request for direction to the trial Court to ensure recording of evidence at the earliest.
In my opinion, an accused has a right to file successive bail applications, as permissible under law, and no liberty of this Court is necessary for filing such bail application either in this Court or in the Court of Sessions Judge having jurisdiction to decide the same.
In view of above, present petition is dismissed as withdrawn with a direction to the trial Court to ensure recording of evidence on the dates already fixed and make an endeavour to conclude the trial at the earliest.
Needless to say that parties shall ensure their effective appearance before the trial Court enabling it to record the evidence and to avoid any unnecessary adjournments.
