Judgment

Heard the learned counsel appearing for the petitioner and learned counsel appearing on behalf of the respondent State.
This application has been filed for grant of regular bail to the petitioner in connection with Bhawnathpur PS Case No.120 of 2025, registered for the offence under sections 109, 61(2) of BNS, 2023, pending in court of learned Judicial Magistrate First Class, Nagar Untari, Garhwa.
The learned counsel appearing for the petitioner submits that allegations are made that to correct the fault in the supply of current, the petitioner has called the injured and he has climbed on the transformer and has come into the contact of 11000- volt power wire resulting to current shock and he fell down on the ground. He further submits that the age of the petitioner is 70 years and said injured person was knowing operation of electricity as he was having own flour mill. He then submits that the petitioner has got no criminal antecedent and the said incident has occurred accidentally. He then submits that the petitioner is in custody since 07.10.2025.
The learned counsel appearing on behalf of the respondent State opposed the prayer of regular bail of the petitioner and submits that the petitioner has called upon the injured person and he forced him to climb on the transformer.
Considering that the petitioner is aged about 70 years and it has been stated that for rectifying the electricity supply fault, the request was made by the petitioner to the injured person and he has voluntarily tried to rectify the supply of current, however, he has come into the contact of 11000-volt power wire and the petitioner is in custody since 07.10.2025, I am inclined to grant regular bail to the petitioner.
Accordingly, petitioner, above named, is hereby directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Nagar Untari, Garhwa, in connection with Bhawnathpur PS Case No.120 of 2025.
