Judgment
The matter was taken up today through Video Conferencing at 11:00 AM.
Heard Sh. Ankur Kumar, Advocate, who has moved the present application (CA No.66/2020) dated 28.01.2020 with a prayer to appoint Sh. Sumit Shukla as the Resolution Professional in the present I & B proceeding.
Sh. Zain Abbas, Advocate appearing for IRP states that he has no objection, if the present application is allowed subject to the condition that, if any amount is due to be paid to the IRP till date, the same may be considered and paid over by the CoC. It is made clear that the said prayer may be made before the CoC, and if any such amount is due to be paid to the present IRP, the same may be considered by the CoC in the next meeting.
In view of the submissions made by the learned counsels for the parties and in view of the averment made by Sh. Ankur Kumar, Advocate that the proceedings have been pending since long, this Court allows the present application as it has been stated by Sh. Ankur Kumar that the CoC has allowed the appointment of Sh. Sumit Shukla by 100% voting shares. In view of the above, the present application (CA No.66/2020) stands allowed. No order as to cost.
Accordingly present application (CA No.66/2020) stands disposed off.
