The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of order dated 20.01.2004 whereby their House No.220, Sector 40-A, Chandigarh has been attached.
Mr. Yogesh Putney, Senior Standing Counsel, during the course of hearing, produced copy of order dated 23.10.2019 passed by ITO, Ward-6(1), Mohali whereby attachment of aforesaid house has been lifted. The said order has been passed with the prior approval of Principal Commissioner of Income Tax, Chandigarh-II. He further submits that in view of the aforesaid order, the instant petition has rendered infructuous.
Copy of order dated 23.10.2019 is taken on record. Registry is directed to tag the same at an appropriate place on the case file.
DISMISSED as having been rendered infructuous.
There is no representation on behalf of the petitioners, thus, they are at liberty to move an appropriate application within three months from today, if cause survives.
