Judgment
The applicant in O.A., stated to be resident of village Kajal Heri, Tehsil and District Fatehabad, has made a complaint against the biogas plant which is being constructed on Khasra No. 577. As per the allegation the applicant is residing near Khasra No. 577 and there are residential houses within 300 mtrs. of the proposed biogas plant. It is further been alleged that there exist water works in north side of Khasra No. 577 and two water bodies have been constructed in these water works to collect the canal water in it and a water course also exist there to lead canal water in the water bodies of water works and the same was situated within 100 mtrs. radius of the proposed biogas plant. It has been alleged that in the construction of the biogas plant, the guidelines of March, 2022 issued by the Central Government are being violated.
During the course of the argument, the applicant present in person has submitted that he had made a complaint on 18.09.2023 to the Nodal Officer, HSPCB, Fatehabad but the said complaint has not been considered. We find that the applicant has approached the Tribunal without waiting for some reasonable time for action on this complaint. We are of the view that the complaint made by the applicant needs to be considered by the concerned authority.
Hence, at this stage, we dispose of the present applicant by directing Nodal Officer, HSPCB, Fatehabad to duly consider the complaint of the applicant in accordance with law within a period of three months from the date of receipt of copy of this order. The applicant is directed to submit a fresh copy of the complaint along with the copy of this order to the competent authority.
The Original Application and I.A. No. 740/2023 are accordingly disposed of.
