Judgment
Heard Mr. B. N. Majumder, learned counsel appearing for the petitioner.
Mr. Majumder, learned counsel has categorically stated that since the police has filed the final report after further investigation, the relief for directing the respondents to complete the investigation within a stipulated period has become infructuous. But Mr. Majumder, learned counsel has submitted that the claim for compensation for negligence, causing death of his wife, still remains live. As this court will not inquire in such cause as, recording of oral evidence might be required. Mr. Majumder, learned counsel has submitted thereafter that he has instruction to withdraw this petition with liberty reserved for taking forward the cause of claiming compensation for the damage the petitioner has suffered for the said negligence.
Prayer stands allowed.
This petition, so far the relief (b) is concerned, is allowed to be withdrawn and accordingly, the same is disposed as withdrawn with liberty reserved in favour of the petitioner to take forward his cause as regards the claim of compensation for negligence.
