Judgment

This writ petition has been filed seeking the following reliefs:
(a) To direct the respondents to constitute the expert committee as directed by this Honourable Court in Exhibit P7 judgment and complete the process within a time frame fixed by this Honourable Court.
(b) To direct the respondents to complete the investigation in Crime No.574 of 2020 of the Ettumanoor Police Station within a time frame fixed by this Honourable Court.
(c) Grant such other relief/s that this Honourable Court may be considered necessary in the interest of justice.
Heard both sides.
The learned Senior Public Prosecutor Smt.T.V.Neema submits that the Apex Body constituted as per Ext.P6 Circular has found that the accused is negligent. A report has already been submitted to the investigating officer. The learned Senior Public Prosecutor further submitted that now the investigation is going on and it will be concluded and final report will be filed at the earliest.
Learned counsel for the petitioner submitted that the long period taken to complete the enquiry by the Apex Body has to be excluded while computing the period of limitation. The learned Magistrate after filing the final report and while taking the cognizance shall take note of the said fact.
Hence, this Writ Petition (Crl) is disposed of directing the investigating officer to complete the investigation and file a final report as early as possible, at any rate, within a period of four months from the date of receipt of a copy of this judgment.
