This Writ Petition (Crl.) has been filed aggrieved by the delay in completing the investigation and filing the further report under Section 173(8) of Cr.P.C.
On the basis of the complaint preferred by the petitioner, a crime was registered against three persons. The initial investigation revealed that no offence under PC Act was attracted and hence, a negative final report was filed before the Enquiry Commissioner and Special Judge, Thiruvananthapuram. However, the special court directed further investigation. After conducting further investigation, a further report was filed, which was also returned. The learned special judge refused to accept the said final report and ordered further investigation again as per Ext.P4 order. According to the petitioner, thereafter, the 3rd respondent is not completing the further investigation. It is in these circumstances, he has approached this Court.
The learned Special Public Prosecutor for VACB produced the copy of a report of the investigating officer. It is stated in the said report that further investigation is almost over and the further report is under preparation. In these circumstances, this Writ Petition (Crl.) is disposed of with a direction to the 3rd respondent to complete the investigation and file further report within a period of one month from today.
This Writ Petition (Crl.) is disposed of accordingly.
