Heard Sri Dinesh. K. Rao, learned counsel for the petitioner and Sri. Satish R. Giriji, learned HCGP for the state/ Respondent.
This petition is filed seeking a direction to the Chintamani Rural POLICE TO a report in CR. No. 62/2009 pending on the of Civil Judge (Junior Division), JMFC, Chintamani as prayed by them by in the requisition dated 23.12.2009.
The said Court had permitted the Investigeting Officer to conduct three re-investigation in the matter All the petitioners have come before this Court in Cr.R No.525/2010 and this Court had directed that since re-investigation is not permitted, the matter is remanded with a direction to consider the application of CPI and pass an appropriate order in compliance with the provision of Section 173(8) of Cr.P.C. The said provisions permit the Investigating Officer to file farther investigation report.
Heard learned counsel for the petitioner in respect of a direction dated 26.04.2010, The police have not filed any further investigation report u/s 173(8) of Cr.P.C inspite of lapse of one and half years. It is further submitted by the learned counsel for the petitioner that, there is no other report and the matter is simply dragged on with no result. Earlier police have filed "B" report. In view of the said position, the police are directed to file any further report on or before 31.12.2011 failing which the proceedings are directed to be quashed.
Accordingly, petition is disposed of.
