Heard Mr. Jayendra Modi, learned advocate for Dr. Rajesh H. Acharya, learned advocate for the appellant and Mr. Kamal Trivedi, learned senior

advocate assisted by Mr. Anuj K. Trivedi, learned advocate for respondent on caveat.

Mr. Modi, learned advocate seeks permission to withdraw this appeal. However, he urges that the learned trial Judge may be directed to dispose of

the ExhibitÂ​5 application as expeditiously within reasonable time.

Permission as prayed for is granted. The Appeal from Order stands disposed of as withdrawn.

The learned trial Judge is directed to decide and finally dispose of the impugned ExhibitÂ5 application as expeditiously as possible in accordance

with law after affording an opportunity of hearing to the parties.

Mr. Modi, learned advocate and Mr. Anuj Trivedi, learned advocate are requested to request their learned counter parts in the trial Court not to

seek unnecessary adjournments and cooperate with the learned trial Judge in expeditious disposal of ExhibitÂ​5 application.

In view of the order passed in main Appeal from Order, Civil Application does not survive and stands disposed of accordingly.
