Judgment

RULE. Learned APP waives service of notice for and on behalf of the respondent – State.
By way of the present application, the applicant has prayed to release him on temporary bail for a period of 30 days on the ground of surgery of his mother.
Considering the fact that last time the present applicant was absconded for a period of 236 days, learned advocate Ms. Bhatt appearing for the applicant on her own volition submitted that the present applicant is ready and willing to deposit a sum of Rs. 1,00,000/- and shall also furnish two local sureties to the same amount and he shall mark his presence before the concerned police station on every alternate day.
Learned Additional Public Prosecutor appearing for the respondent has opposed this application.
Considering the aforesaid facts and circumstances of the case and reasons stated in the application as well as looking to the jail record of the applicant, I am of the opinion that the present application requires consideration as the co-ordinate Bench of this Court has allowed the application on imposing conditions hence, the same is required to be allowed.
The applicant shall be released on temporary bail for a period of 2 weeks from the date of his actual release on usual terms and conditions and on executing a personal bond of Rs.10,000/- (Rupees Ten Thousands) and upon depositing of Rs. 1,00,000/- with two local sureties of the same amount to the satisfaction of the concerned Jail authority. The applicant shall surrender before the Jail Authority on completion of temporary bail period, without fail. The applicant shall mark his presence on every alternate day before the concerned police station.
Rule is made absolute to the aforesaid extent. Registry is directed to communicate this order to the concerned Jail Authority by fax / email message forthwith. Direct service is permitted.
