This is an application under Section 482 of Cr.P.C. seeking indulgence of this Court for extension of period of temporary bail granted by this Court for three months vide order dated 18/08/2023 passed in M.Cr.C. No.21766/2023 to present applicant.
Learned counsel for the applicant submits that applicant is 60 years of age and suffering from Diabetes Mallitus. Because of his previous medical history, his condition has further deteriorated. It is further submitted that he has been continuously receiving the medical treatment from the Neuro Psychiatrist and has been advised complete bed rest. Copy of the medical documents are annexed as Annexure A/3. Hence, prays for further extension of period of temporary bail granted by this Court to present appellant.
Upon consideration of the reasons assigned in the application and perusal of documents annexed, temporary bail granted by this Court vide order dated 18/08/2023 passed in M.Cr.C. No.21766/2023 is further extended for a period of eight weeks from the date of expiry of period of temporary bail.
The applicant shall surrender before the concerned trial Court immediately after completion of above period of eight weeks, failing which the trial Court shall be free to issue warrant of arrest against the applicant and intimate the Registry of this Court.
Rest of the order dated 18/08/2023 passed in M.Cr.C. No.21766/2023 shall remain intact.
This order shall be read in conjunction with the order dated 18/08/2023 passed in M.Cr.C. No.21766/2023.
With the aforesaid, the present petition under Section 482 Cr.P.C. stands disposed of.
