The grievance of the applicant is cutting of trees without any permission by the respondents in Mayur Vihar Phase-II, Delhi. The matter was reported to the Deputy Conservator of Forests who issued notice to the respondents and found the persons guilty of the offence under DPTA, 1994 and imposed penalty @ Rs. 20,000/- per tree initially for 14 trees amounting to Rs. 2,80,000/-.

The contention of the applicant is that the amount for penalty is too less and the assessment of rest of the trees had not been done by the Deputy Conservator of Forests.

Since the matter of taking action is pending with the Deputy Conservator of Forest, thus, we direct the Deputy Conservator of Forests, Central Forest Division, Kamla Nehru Ridge, Delhi for taking further action for realization of the penalty in accordance with the rules and to take necessary actions for the rest of the matters which are pending with the Forest Department. The action should be taken within a reasonable time (say within 60 days). The amount of penalty shall be utilized for the purposes of plantation in the area.

With these observations, the application stands disposed of.
