Judgment
Grievance in this application is against cutting of trees by M/s Perfect Builder Pvt. Ltd. and M/s First Rate Solution (P) Ltd., New Rohtak Road, Near MTNL Office, Karol Bagh, New Delhi and Sh. A.K. Sood in Village Bhati and village Fatehpur Beri, South Delhi - 110074.
It is stated that builders are developing illegal colonies on 18 acres of land after cutting more than 1000 trees. They are also undertaking extraction of groundwater for the swimming pool. The applicant gave representation, inter-alia dated 29.10.2021, to the Commissioner of Police, Chairman DDA, Commissioner SDMC, Deputy Conservator of Forest (South) and Deputy Commissioner, SDMC but no action has been taken.
We are of the view that the issue of cutting of trees has to be first looked into by the Tree Officer under the Delhi Preservation of Trees Act, 1994. The said remedy does not appear to have been taken.
Accordingly, the application is disposed of without prejudice to the remedy of the applicant as per law.
All pending I.A.s also stand disposed of.
