Judgment
V. Narasingh, J
Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is an accused in T.R. Case No.95 of 2020 pending on the file of learned Addl. Sessions Judge-cum-Special Judge, Jeypore arising out of Jeypore Sadar P.S. Cse No.241 of 2020 for commission of the offence under Section 20(b)(ii)(C) of the N.D.P.S. Act.
Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Addl. Sessions Judge-cum-Special Judge, Jeypore by order dated 05.10.2023 in the aforementioned case, the present BLAPL has been filed.
Perused the note of the Registrar (Administration) in-charge and communication received from the learned District Judge, Koraput-Jeypore. In his note dated 2.1.2024, learned District Judge has indicated that he is now in seisin of the matter.
Considering the same, learned Court in seisin is requested to conclude the trial by end of February, 2024 in view of the order dated 7.12.2023 passed in BLAPL No.7966 of 2022 relating to co-accused Shiv Shankar Patel.
Accordingly, BLAPL stands disposed of.
Liberty is given to the Petitioner to renew his prayer in the event the trial is not concluded by end of February, 2024.
Registry is requested to communicate this order to the learned Court in seisin..
