Judgment
V. Narasingh, J
Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is an accused in 2(a)CC Case No.25 of 2021 (N) pending on the file of learned Special Judge-cum-3rd Addl. Sessions Judge, Berhampur, Ganjam, arising out of P.R. No.13 of 2021-22 for commission of the offence under Section 20(b)(ii)C of the N.D.P.S Act.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Special Judge-cum-3rd Addl. Sessions Judge, Berhampur, by order dated 9.1.2023 in the aforementioned case, the present BLAPL has been filed.
Perused the report submitted by the learned Court in seisin indicating that the case is posted to 09.08.2023 for defence evidence.
Learned Court in seisin is called upon to make an endeavour to conclude the trial within a period of two months as sought for.
Registry is requested to communicate this order to the learned Court in seisin.
The explanations submitted by the Superintendent and the Dealing Assistant shall be dealt with in a separate sheet.
The BLAPL is accordingly disposed of.
