Judgment
V. Narasingh, J
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is an accused in connection with T.R. Case No. 46 of 2022, pending before the Court of the learned Additional Sessions Judge-cum-Special Judge, Gunupur, arising out of Padmapur(Dist-Rayagada) P.S. Case No. 40 of 2022 for alleged commission of offences under Sections 20(b)(ii)(C)/25/29 of NDPS Act.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-Special Judge, Gunupur, by order dated 20.01.2023 in the aforementioned case, the present BLAPL has been filed.
Perused the report of the learned Special Judge dated 19.07.2023 indicating that out of 18 cited witnesses 3 have already been examined and has indicated that the trial likely to be concluded within 4 months.
Considering the same, this Court is NOT INCLINED to entertain this bail application at this stage.
Learned Trial Court is called upon to make an endeavor to conclude the trial within the period of 5 months from the date of receipt/Production of copy of this order.
In the event, trial is not concluded within the time stipulated, it shall be open to the Petitioner to renew his prayer before the learned Court in seisin which shall be considered on its own merit.
Registry is requested to do the needful.
Accordingly, the BLAPL stands disposed of.
Urgent certified copy of this order be granted as per rules.
