Judgment
Challenging the action of respondent No.2 in calling the petitioner to produce his vehicle bearing No. TG-38-2540, Omnibus before respondent No.2 as illegal and arbitrary, this Writ Petition is filed.
Brief facts leading to filing of the present Writ Petition are that the petitioner has purchased vehicle bearing No. TG-38-2540 after perusal of the legal documents and after paying valid consideration to the vehicle's owner and therefore it is the case of the petitioner that he is not responsible for the dues, if any of his vendor and for his default, the petitioner should not be directed to produce the vehicle.
Learned Assistant Government Pleader for Home on written instructions submitted that the Branch Manager at Cholamandalam Investment and Finance Company Limited, Mahaboobnagar, has given a complaint on 20.06.2026 at 09:00 hours with regard to purchase of the property by one Srikanth, by hypothecating the vehicle to the company and that without making repayment of the loan and by creating fake NOC of the company, he has sold the property to the petitioner. The FIR No.118 of 2026 was consequently registered and investigation has been taken up. According to the police, the vendor Mr. Srikanth has created fake NOC and sold the same to the petitioner and the petitioner has purchased it with full knowledge of the fake NOC and therefore the petitioner is also responsible and has accordingly been arrayed as accused No.2 in the complaint.
At this stage, the learned counsel for the petitioner submitted that the petitioner had no knowledge about fake NOC and that the petitioner is however ready and willing to cooperate with the investigation and to produce the vehicle as and when required for the investigation.
Having regard to the rival contentions and material on record, this writ petition is disposed of directing the respondents to conduct investigation into the complaint strictly in accordance with law and the petitioner is also directed to give an undertaking to respondent No.2 that he would not change the nature of the vehicle and will not alienate the vehicle and also that he would produce the vehicle as and when required and also shall give surety for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) and subject to the same, respondent No.2 shall permit the petitioner to operate the vehicle.
No order as to costs.
Miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
