Application is registered based on a complaint received by post/e-mail

This original application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 on the basis of a letter petition dated 09.09.2022 received from National Environment Care Federation (R.) through its President.

The complaint is that Mangalore Smart City Corporation Limited, Mangalore (MSCCL) in the process of widening of road from Nandigudda to Marnimakatte is proposing to cut several trees for which proceedings for consent/permission by Forest Authorities is in process. The local residents have raised protest on the proposal of cutting of trees but the Forest Authorities are not considering these objections but bent upon to grant permission.

In our view the grievance at the first instance can be looked into by the Local Authorities, for the purpose whereof, we constitute a joint Committee comprising PCCF (HoFF), Karnataka, State PCB, District Magistrate, Mangalore and Municipal Commissioner, Mangalore who shall look into the complaint, visit the site, collect relevant information and if finds violation, take appropriate remedial action in accordance with law within two months.

The District Magistrate, Mangalore shall be nodal agency for coordination and compliance.

The said Committee shall submit an action taken report with the Registrar General of this Tribunal who shall place the report before the Bench if find necessary for any further order.

The   report   shall   be   submitted   by   e-mail   at judicial- [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF.

With the above direction/observations this OA is disposed of.

A copy of this order alongwith complaint be forwarded to the PCCF (HoFF), Karnataka, State PCB, District Magistrate, Mangalore and Municipal Commissioner, Mangalore by email for compliance.
