Judgment
ORDER
By Hon’ble Mr. Rajnish Kumar Rai, Member (J):-Heard, Shri Avadhesh Kumar Upadhyay, counsel for the applicant and Shri Anil Kumar, counsel for the respondents.
The instant original application has been filed seeking following reliefs: -
“(i)To issue any other suitable order or direction directing the respondents to produce the relevant records concerning the implementation of the Grade Pay Rs.4800/- cadre upgradation scheme for the Senior Section Engineers (Signal) of the Prayagraj/NCR division.
(ii)To issue any other suitable order or direction commanding the Respondents to consider and decide the pending representation of the Applicant dated 16.03.2026 objectively in a time-bound manner.
(iii)To issue any other suitable order or direction directing the respondents to grant the benefit of financial upgradation in Grade Pay Rs.4,800/- to the Applicant retrospectively from the date of his entitlement based on his Seniority Position No.3, along with all consequential benefits.
(iv)To issue any other suitable order or direction directing the respondents to recalculate, revise, and release the post-retirement pensionary benefits (including pension, gratuity, Central Administrative Tribunaland leave encashment) based on the upgraded pay structure, along with an applicable rate of interest on delayed arrears.
(v)To issue any other suitable order or direction as this Hon’ble Tribunal may deem fit and proper in the circumstances of the case.
(vi)To award cost of the petition in favour of the applicant.”
Learned counsel for the applicant submitted that the applicant is retired from the post of SSE/Signal/MNQ from the office of DSTE/TDL on 31.03.2026. He submitted that during the service period he has moved an application for upgradation in the Grade Pay of Rs.4,800/- on the basis of his seniority; however, the same has not been considered in the light of Railway Board upgradation to the pay structure of certain Group ‘C’ cadres staff of the Signal and Telecom Department, as 50% of the posts in the Grade Pay Rs.4600/-was to be upgraded in the Grade Pay of Rs.4800/- on the basis of seniority. Therefore, the applicant has moved representation dated 16.03.2026 before the Respondent authority for considering the upgradation in the Grade Pay of Rs.4800/-, as per mandatory 50% upgradation of the posts, which is pending for consideration and therefore, desires that his representation may be decided by passing a reasoned and speaking order within a time bound manner.
Learned counsel for the respondents has no issue if an order to decide the representation of the applicant is passed without going into the merit of the case.
Without going into the merits of the case and considering the limited prayer made by the applicant, this Tribunal is of the view that the Original Application can be disposed of at this stage.
Accordingly, the Original Application No.1011/2026 is disposed of with a direction to Respondent Authority to consider the grievance of the applicant by deciding the pending representation of the applicant dated 16.03.2026 by passing a reasoned and speaking order, within a period of three months from the date of receipt of a certified copy of this order.
No order as to costs.
