Learned Counsel Mr. A S Panesar appeared for the Operational Creditor. Learned Counsel Mr. Mohit Gupta appeared for the Corporate Debtor.
Learned counsel for the Corporate Debtor submit that the Corporate Debtor has already been admitted in CIRP in CP (IB) No. 68 of 2020 vide order dated 15.03.2021. Hence, this application stands disposed of under Section 14 IBC with liberty to Financial Creditor to file its claim before IRP/RP in that proceeding.
We also give liberty to Financial Creditor to revive this proceeding in case CIRP of the Corporate Debtor is set aside.
Hence, CP (IB) No. 239 of 2019 become infructuous and stands disposed of.
