Judgment
Heard learned counsel for the petitioner and learned counsel for the Official Liquidator (OL) representing respondent company. The MA under consideration bearing No. 14 of 2021 has been preferred by the petitioner with a prayer that the main petition which is of the year 2014 may be heard urgently. The ground is that substantial amount of Approximately Rs. 22 crores has been claimed by the petitioner from the respondent company. The respondent company is under liquidation which is progressing fast and if the claim is not determined, the petitioner, a Public Sector Undertaking may suffer irreparable injury because the assets may get distributed without considering the claim of the petitioner.
In the facts of the case, prayer for early hearing is allowed.
Learned counsel for the respondent submits that two weeks' time may be given to get ready for hearing of the matter on merits. This prayer also appears reasonable.
Let T P No. 280 of 2014 be listed for hearing on top of the list on 12.10.2021.
M A No. 14 of 2021 contains some other prayers but the same are not being pressed at this stage and M.A is allowed to the aforesaid extent.
