Heard the submissions made by the Ld. Counsel for the Operational Creditor. Certain invoices which were attracted by Section 10A of the Code, 2016 have to be excluded. Therefore, the applicant has prayed for an opportunity to withdraw the present petition and prayed for liberty to file fresh petition by excluding those invoices which were covered under Section 10A of IB Code, 2016.
Leave prayed for is granted.
The present Section 9 application is dismissed as withdrawn with liberty to file fresh application, if the outstanding invoices exceed threshold limit of Rs.1 Crore.
