ORDER
This is a petition under Section 9 of IBC, 2016. Heard the submissions made by Ld. Counsel for the Operational Creditor. During the course of arguments it transpires that certain invoices claimed in the petition as well as Section 8 notice fall within the period mentioned in Section 10A of the IBC, 2016. In view of this, Ld. Counsel sought liberty to withdraw the present petition. Ld. Counsel for the Operational Creditor is given liberty to withdraw the present petition i.e. IB-218/ND/2023. Therefore, the present petition i.e. IB-218/ND/2023 is dismissed as withdrawn. All papers may be consigned to the record room.
