Judgment
This Criminal Petition is filed seeking to direct the learned Family Court Judge at Mahabubnagar, to dispose of the application filed by the petitioner vide Crl.M.P.No.67 of 2023 in M.C.No.22 of 2022 as expeditiously as possible.
Heard Mr.Daraboina Subramanyam Yadav, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.2.
Notice in respect of respondent No.1 is dispensed with solely on the ground that the petitioner is not seeking any relief, much less any effective relief against respondent No.1, and is only seeking expeditious disposal of the application which was filed by the petitioner pending before the family Court.
Learned counsel for the petitioner submits that the petitioner has filed M.C.No.22 of 2022 against the respondent No.1 under Section 125 of the Cr.P.C., seeking maintenance. In the said M.C., the petitioner has also filed Crl.M.P. No.67 of 2023 under Section 125(3) of the Cr.P.C., seeking interim maintenance. The said application was filed on 05.07.2023 and has been pending since then. He further submitted that, the learned trial Court without considering the said application, adjourning the matter from time to time. He further submitted that unless this Court fixes a time limit for the conclusion of the trial and disposal of the case, the petitioner will be put to great hardship.
Having considered the submissions made by the learned counsel for the petitioner, and without expressing any opinion on the merits of the application or the grounds urged in the present criminal petition, the learned Family Court Judge at Mahabubnagar is directed to dispose of Crl.M.P.No.67 of 2023 in accordance with the law as expeditiously as possible, preferably within a period of three (03) months from the date of receipt of a copy of this order. It is made clear that the parties in lis shall cooperate with the trial Court without seeking undue adjournments.
Accordingly, the Criminal Petition is disposed of.
Miscellaneous applications, pending if any, shall stand closed.
