Judgment
ORDER : (ORAL)
Heard Mr. P.V.K.Prudhvi Samrat, learned counsel for the petitioners; Mr. M.Sahas Reddy, learned Assistant Government Pleader for Revenue, appearing for respondents No.2 and 4; Mr. Putta Krishna Reddy, learned Standing Counsel for respondent No.3; and perused the material on record.
Learned counsel for the petitioners submitted that several documents including the revenue records have been submitted by the petitioners to show that they are in possession of the subject properties in Survey No.7A, situated at Kothuru Village and Municipality, Ranga Reddy District, for the past several years. However, such documents have not been considered by the respondent authorities. The petitioners are small traders and eking their livelihood by running petty businesses. The action of the respondent authorities in passing the speaking order vide Lr. No.59/2026 dated 05.09.2026 is in violation of principles of natural justice.
Learned Assistant Government Pleader for Revenue and learned Standing Counsel for respondent No.3 submitted that the petitioners are claiming possession in respect of the subject properties on the basis of a Sadabainama which is not a valid document. During the enquiry, it was found that the petitioners do not have any title in respect of the subject properties. Even after multiple opportunities of hearing were given to the petitioners, they have not submitted any reply or documents in support of their case.
Learned counsel for the petitioners furnished certified copies of pahanies for the years 1955-58, 1969-70, 1971-72, 1974-75, 1976-77, 2002-03, 2007-08, 2008-09 and submitted that the predecessors-in-title had been in possession and enjoyment of the subject properties for several years.
However, considering the economic status of the petitioners, this writ petition is disposed of directing respondents No.2 to 4 to maintain status quo in respect of the subject properties subject properties in Survey No.7A, situated at Kothuru Village and Municipality, Ranga Reddy District for a period of four (4) weeks from today. Within this time, the petitioners are directed to submit representation to respondent No.3 along with supporting documents. As and when such representation and documents are submitted, respondent No.3 shall consider the same by giving opportunity of hearing to the petitioners and to all other concerned/interested persons, and pass appropriate orders in accordance with law within a period of two (2) weeks thereof. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
