Judgment
With the consent of both parties, this Writ Petition is taken up for disposal at the admission stage.
This Writ Petition is filed seeking to declare the action of respondent Nos.4 and 5 in issuing letters bearing F. No.ECIR/HYZO/12/2024, dated Nil.07.2026 and 12.06.2025, to respondent Nos.6 and 7, without following the due process of law and also the action of respondent Nos.6 and 7 in placing/retaining the petitioner's property i.e., Unit No.DG1- G/04/05, in Fourth Floor of Block Vista Diego Garcia - 1, bearing Municipal No.15-31-RTP-1-DG1-G/04/05, PTIN No.1141516521, with a built up area 2475.0 sq. feet, (Including common areas and balconies), along with an undivided share of land admeasuring 101.0 sq. yards, along with car parking area admeasuring 221.0 sq. feet, in Survey No.1009/1 (Part), at Raintree Park, Situated at adjacent to Phase - V, KPH Colony, Kukatpally Village And Mandal, Under GHMC Kukatpally Circle, Medchal-Malkajgiri District, vide Document No.2542 of 2023, registered Kukatpally S.R.O., under restraint/in the prohibitory list under 22-A of the Registration Act, 1908.
Heard Sri E. Venkata Siddhartha, learned counsel for the petitioner; Sri N.Bhujanga Rao, learned Deputy Solicitor General of India, appearing for respondent No.1; and learned Government Pleader for Stamps and Registration, appearing for respondent Nos.2 to 7.
Learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of subject property, having purchased the same by way of registered Sale Deed vide Doc. No.2542 of 2023. Since the date of purchase, the petitioner has been in continuous, peaceful and uninterrupted possession and enjoyment of the said property. However, without any notice to the petitioner, the subject property was included in the prohibitory list basing on the letter dated 22.07.2025. Therefore, learned counsel prays this Court to permit the petitioner to submit a representation to respondent No.3 seeking deletion of the subject property from the prohibitory list and that respondent No.3 may be directed to consider the same and pass appropriate orders, within a time-frame stipulated by this Court.
Learned Government Pleader appearing for respondent Nos.2 to 7 fairly submits that respondent No.3 will consider the petitioner's representation, as and when received, in accordance with law.
Having regard to the submissions made by learned counsel for the respective parties and without going into merits of the case, this Writ Petition is disposed of permitting the petitioner to submit a representation to respondent No.3 for redressal of his grievance, within a period of ten (10) days from the date of receipt of a copy of this order. Upon receipt of such a representation, respondent No.3 is directed to consider the same and pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks therefrom. It is made clear that upon considering the said representation, if the petitioner is still aggrieved, she is at liberty to approach this Court.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
