MA No. 2981/2019 for joining together is allowed for the reasons stated therein.

This Original Application (OA) has been filed by the applicants seeking the following reliefs:-

"(a) Grant the benefits of pension and other pensionary benefits with interest as granted by this Hon'ble High Court of Delhi in the identical case on 14.09.2016 in Writ Petition (C) No. 6630/2016;

(b) Grant the benefits of pension and other pensionary benefits with interest as granted by this Hon'ble High

Court of Delhi in the identical case on 30.11.2018 passed by CAT, PB, ND in OA No. 3972 of 2016; and

(c) pass any other order or grant any other relief as this Court may deem fit."

It is noted that the legal notice has only been given on 08.04.2019 but no proof of service is provided in the said notice. It is also noted that the period of six months have not elapsed before filing of the OA. and as such, under Section 20 of the AT Act, 1985, the applicants can only approach the Tribunal after first having exhausted all his remedies which they have not done in the present matter.

However, in view of the legal notice given by the applicants on 08.04.2019, the OA is disposed of, without going into the merits of the case, by directing the respondent to pass a reasoned and speaking order on the said legal notice of the applicants, within a period of 90 days of receipt of a copy of this order.

With the above directions, the OA stands disposed of at the admission stage itself.
