Judgment
Hon'ble Mr. R. N. Singh, Member (J): The applicants, eight in numbers, have filed the present OA under section 19 of the AT Act, 1985 seeking the following reliefs :-
"(a)Directing the respondents to place the relevant records pertaining to the present O.A. before the Hon'ble Tribunal for the proper adjudication in the matter.
(b)Directing the respondents to consider and finalize the request of the applicants for extending the benefits of General Provident Fund Scheme as the applicants were duly appointed on Muster Roll between 1990- 1995, accorded the status of Regular Muster Roll in the year 2002 and were appointed as Safai Karamchari, Group-D in the year 2007 in terms of the settled by the Hon'ble Punjab & Haryana High Court in CWP No. 2371 of 2010 titled as Harbans Lal vs. State of Punjab and others, decided on 31.08.2010 further upheld by the Apex Court with all other consequential benefits.
(c)Allowing the OA with costs.
(d)Any other fit and proper relief may also be granted."
The applicants have filed the aforesaid MA No. 1515/2021 seeking permission from this Tribunal to file the aforesaid OA jointly. For the reasons recorded in the MA, the same is allowed.
Learned counsel for the applicants, Shri U. Srivastava submits that the applicants are entitled to be regulated under the Old Pension Scheme in view of the various judgments. However, in spite of the applicants' representations dated 12.11.2020 (Annexure A-1) neither the grievances of the applicants have been redressed nor any response on the said representations have been received.
Issue notice. Ms. Sriparna Chatterjee, learned counsel, who appears for respondents on advance service, accepts notice.
Further, without going into the merits of case, the present OA is disposed of with a direction to the respondents to consider the applicants' aforesaid pending representations dated 12.11.2020 (Annexure A-1) and to dispose of the same by passing a reasoned and speaking order as expeditiously as 4 OA No-1229/2021 possible and in any case within ten weeks of receipt of a copy of this order. No costs.
