Hon’ble Mr. R.N. Singh, Member (J):

In the present OA filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant is seeking the following reliefs:

“i.

Please to quash and set aside the impugned Office Order No.AIIMS/NGP/Admin./Letter/24/2762 dated 23.11.2024, whereby adverse un-communicated entries for the period from 01.04.2021 to 31.03.2022 was remain unchanged (Annexure No. A-1)

ii.

Quash and set aside the Office Order No.Admin/AIIMS/Off. Ord/No/2023/1597 dated 29.08.2023., Office Order No.Admin/(Non-Acad)24/SNO/PO/77 dated 12.04.2024 and Office Order No.AIIMS/NGP/NE/03/LR/012/2024 dated 31.12.2024 to the extent of non-inclusion of the name of the applicant and further be pleased to direct the respondents to issue additional corrigendum to the said office order by including the name of the applicant as per his seniority (Annexure No. A-2).

ii.

Further be pleased to direct the respondents to promote the applicant to the post of Senior Nursing Officer (Level-8) with effect from 29.08.2023 (the date on which similarly placed employees were promoted) with all consequential benefits.

iv.

Grant any other relief may deem fit and proper.

v.

The Petition may be allowed with cost.”

The claim of the applicant was contested by the respondents by filing reply to which the applicant has also filed rejoinder and a Sur-rejoinder thereafter has also been filed by the respondents. However, today, Mr. Pandit, learned counsel appearing for the respondents, has brought on record an order dated 08.09.2026 after supplying a copy thereof to the learned counsel for the applicant and a copy of which is also found to be endorsed to the present applicant. The order dated 08.09.2026 under reference reads as under:-

“Consequent upon the approval of the Competent Authority, AIIMS Nagpur, it is hereby conveyed that the order (bearing No: AIIMS NGP/Admin/Letter/2024/2762 dt. 23/11/2024) issued to Shri Pavan Chakrawat, Nursing Officer [Emp ID: NURSING/NO/19/04] against his representation for review of his overall grading for the APAR Period 2021-2022, stands withdrawn with immediate effect.

All its consequences shall follow.

This order is issued with the approval of the Competent Authority, AIIMS Nagpur.”

In the light of the aforesaid development in the matter, learned counsel for the applicant fairly submitted that the present OA may now be disposed of. We order accordingly.

There shall be no order as to costs.
