The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue her passport.
Learned counsel for the petitioner inter alia contends that petitioner was issued passport wherein date of birth of the petitioner was recorded as 12.12.1977 whereas her correct date of birth is 12.12.1978. The petitioner has got her date of birth corrected in different documents. She is seeking correction on the basis of her date of birth recorded in the service record of her husband.
Ms. Shweta Nahata, Sr.Panel Counsel submits that passport authority vide order dated 14.05.2024 has rejected request of the petitioner seeking change of date of birth, thus, the present petition has rendered infructuous. She further submits that the if she files fresh application with concrete evidence in support of her claim, it would be considered in accordance with law.
Learned counsel for the petitioner agrees to aforesaid arrangement.
In the wake of statements of both sides, the present petition stands disposed of.
