The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue her passport with correct date of birth.

The petitioner was issued passport on 11.08.2021. In the said passport, date of birth of the petitioner has been recorded as 01.01.1979 whereas correct date of birth is 02.06.1980. The petitioner is relying upon documents issued by the Indian Army which are disclosing correct date of birth of the petitioner.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner has moved an application seeking correction whereas he has not applied for re-issuance of passport. She further submits that petitioner may be directed to appear before passport authority alongwith requisite documents. The passport authority would do the needful within six weeks thereafter.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 04.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 04.01.2024. It is made clear that if petitioner has not filed application as per prescribed procedure, she would move an appropriate application seeking passport.
