Judgment
2/29.07.2026 Heard learned counsels for petitioner and for State.
The petitioner is apprehending his arrest in connection with Ghaghra PS Case No.66 of 2023, for offence registered under section 407, 411, 420 and 34 of IPC, pending in court of learned Judicial Magistrate First Class, Gumla.
Learned counsel for petitioner submits that the petitioner is not named in the FIR and subsequently name of the petitioner has surfaced. He also submits that two of the co-accused persons have been granted anticipatory bail by this Court in ABA No.10106 of 2023 and ABA No.9720 of 2023. He next submits that the allegations are there of not delivering the eggs to the destination and in the FIR the photograph of driver is also annexed. He next submits that subsequently it was alleged that the petitioner was the driver. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 of the petition.
Learned State counsel opposes prayer and submits that name of the petitioner has come in course of the investigation.
Considering that the petitioner is not named in the FIR and name of the petitioner has surfaced later on and two of the co-accused persons have been granted anticipatory bail as aforesaid and even the photograph annexed in the FIR of the driver of the vehicle on which the eggs were loaded and the allegation is made that the eggs did not reach to the destination and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner.
Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Gumla, in connection with Ghaghra PS Case No.66 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
