Judgment
This original application has been filed by President of AB Block Market Welfare Association, Safdarjung Enclave, New Delhi, raising a grievance against the “Rajinder Da Dhaba” with the plea that the said project proponent is violating the environmental norms and creating nuisance in that area. In the complaint which is enclosed along with the application, issue of noise pollution has been raised. Applicant present in person has submitted that the generator has been kept by the project proponent unauthorizedly and tandoors are being used illegally in the open area. He has also submitted that complaint enclosed with the original application was made to the Chairman, Delhi Pollution Control Committee (DPCC) but no action has been taken till now.
Considering the nature of grievance which has been raised by the applicant, we are of the opinion that complaint which is made by the applicant needs to be duly considered by the Chairman, DPCC and requisite action is required to be taken after ascertaining the correct position and giving the parties an opportunity of hearing if any violation is found.
Hence we dispose of the OA directing the Chairman, DPCC to duly consider the complaint of the applicant in accordance with law and take appropriate action as expeditiously as possible.
Let a copy of this order along with copy of the original application be forwarded to the Chairman, DPCC.
