ORDER
The Learned Lawyer appeared on behalf of the Respondent by filing Vakalatnama.
None appeared on behalf of the Petitioner on repeated call.
On perusal of the record, it is found that the matter is pending since 12.09.2018 on which date the Petitioner took time to remove the objection. Thereafter, on 20.09.2018 and 26.09.2018, the Petitioner again requested time to remove the defect. On removal of the defect the notice was issued through Registry to the Respondent on 03.10.2018. Since, the service could not be affected upon the Respondent, Petitioner was directed to make a paper publication. Thereafter on 07.02.2019 and 03.04.2019, the Learned Lawyer for the Petitioner again took adjournment and made no endeavour to proceed with the case by advancing the arguments. On 18.06.2019 the Learned Lawyer for the Petitioner found absent and the matter was listed for argument today but today also none appeared for the Petitioner.
On perusal of the record, it is found that the Petitioner is not interested in proceeding the case.
Accordingly, the matter is dismissed for non-prosecution.
