The Court is convened through Video Conference.
None present on behalf of the Petitioner. However, Mr. Shadab S. Jan, Ld. Counsel for the Corporate Debtor Present.
This is a Section 9 Petition filed by an Operational Creditor viz. High Ground Enterprise Ltd. against the Corporate Debtor viz. Swastik Productions Pvt. Ltd.
On 18.01.2021 when the case was taken up none was present. On 16.03.2021, the matter could not be taken up due to technical glitch. On 14.07.2021 the matter was taken up and the Counsel for the Respondent was present but there was no representation from the side of the Petitioner. The matter was last listed on 24.08.2021 but it could not be taken up due to paucity of time. Finally, when the matter is called twice today nobody present on the part of the Petitioner.
In view of the continuous failure of the Petitioner to appear and argue the case, the Petition CP(IB)-696(MB)/2020 is dismissed on account of non-prosecution.
