Noorddin vs State of Haryana

Jaswant Singh, J.—Prayer is u/s 438 Cr.PC for grant of anticipatory bail to the Petitioner Noorddin in case FIR No. 107 dated 9.4.2010 under Sections 420, 467, 468, 471, 188 of Indian Penal Code registered with Police Station Tauru, District Mewat.

It is submitted that the Petitioner was Distributor of Airtel Company whereas the co-accused Munimji was the retailer. As per allegations in the FIR, complainant Anshu Gupta, had applied for Airtel Mobile connection and submitted his ID/documents. He was, however, given a connection on someone else''s identity.

Learned Counsel submits that co-accused retailer has been granted the concession of pre-arrest bail. Further submits that it was the retailer who was responsible for ensuring that the connection was given against correct ID. He further submits that the Petitioner has joined the investigation.

Learned State counsel on instructions from ASI Sukh Ram submits that pursuant to the interim order passed by this Court Petitioner has joined the investigation and is no longer required for custodial interrogation.

In view of the above, interim protection/bail granted vide order dated 04th of October, 2010 is made absolute.

Petition stands disposed of.
