Judgment
Jaswant Singh, J.—Prayer u/s 438 Cr.P.C is for grant of anticipatory/pre arrest bail in case FIR No. 189 dated 19.8.2010 under Sections 420/465/467/468/471 IPC read with Section 120B IPC, P.S Civil Lines, Patiala.
As per allegations in the FIR lodged by complainant-Naresh Gupta, the stand of B.S. Fasteners initially in the suit filed by M/s S.S. Tools was that there was no agreement to sell dated 15.10.2004/20.10.2004 between the parties. However, at a later stage, the Directors suffered a statement dated 12.3.2010 (P.5) taking a u-turn. Thus, the allegation was that the complainant had been cheated.
This Court vide its order dated 11.10.2010 had granted interim protection to Petitioner Nos. 3 & 4, who are wives of Petitioner Nos. 1 & 2 respectively and the sleeping partners of the firm-B.S. Fasteners and as such Crl.M. No. 30120-M of 2010 #2# had no role in the running affairs of the firm.
Learned state counsel, on instructions from ASI Sohan Singh, states that Petitioner Nos. 3 & 4 have joined investigation and their custodial interrogation is no longer required.
In view of the above, interim protection/bail granted vide order dated 11.10.2010 is made absolute.
Petition stands disposed of.
