Judgment
Jaswant Singh, J.—Prayer u/s 438 Cr.P.C is for grant of anticipatory/pre arrest bail in case FIR No. 592 dated 20.10.2010 under Sections 420/468/467/471 IPC, P.S Central Faridabad, District Faridabad.
Allegations against the Petitioner are that he was inducing customers-residents of the area to buy two bed room flats for a sum of Rs. 9 lacs being constructed by Lord Budha Housing Society, Faridabad. Promotor/owner of the Lord Budha Housing Society was one Kapil Suri, a tenant of the Petitioner. The booking amount being received was 10% of the sale consideration i.e Rs. 90,000/-.
Learned Counsel submits that all the payments qua booking were received through cheque, which were credited in the accounts of main accused Kapil Suri. Alleged bogus receipts were also issued by Kapil Suri. It is further submitted that Petitioner himself had booked one plot and had Crl.M. No. 33721-M of 2010 #2#
been duped of his booking amount.
Learned state counsel, on instructions from ASI Babu Lal, states that the Petitioner has joined investigation and his custodial interrogation is no longer required.
In view of the above, interim protection/pre arrest bail granted vide order dated 30.11.2010 is made absolute.
Petition stands disposed of.
