Heard the learned counsel for the petitioner and learned Public Prosecutor for the 1st respondent.
This Criminal Petition is filed against the registration of the Crime No.11 of 2021 before the Kota Police Station, SPSR Nellore District, for the alleged offences under Section 406, 465 IPC against the petitioners Nos.1 to 7 at the instance of the 2nd respondent-complainant. The counsel for the petitioner submits that it is purely a civil dispute and the above said criminal case was foisted by the 2nd respondent in order to harass the petitioners and the police are interfering by summoning the petitioners to the Police Station under the guise of investigation.
On the other hand, the learned public prosecutor submits that since the case was duly registered as cognizable offence in Crime No.11 of 2021 for the offences under Sections 406 and 465 IPC, the Police would proceed in accordance with law, during the course of investigation.
In view of the nature of the offences alleged as stated above, the Police are directed to follow the procedure by giving Section 41-A Cr.P.C notice to the petitioner as per the guidelines issued by the Hon’ble Supreme Court of India in the case of Arnesh Kumar Vs. State of Bihar 2014 (8) SCC 273.
Accordingly, this Criminal Petition is disposed of.
As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
