Judgment

Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the 1st respondent.
This present Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking to quash the proceedings against the petitioners/Accused Nos.1 and 2 in Crime No.84 of 2022 on the file of Gudivada I Town Police Station, Krishna District, registered for the offences punishable under Sections 406, 418, 420, 506 read with Section 34 of the Indian Penal Code, 1860.
Though the learned counsel for the petitioners raised several grounds in the Criminal Petition for quashing the proceedings against the petitioners, at the time of arguments, confined his arguments to the relief of disposing of the matter by directing the Police to follow the procedure as contemplated under Section 41A of Cr.P.C.
In the light of the said submissions, without going into merits of the case, Criminal Petition is disposed of, directing the Investigating Officer/Police to follow the procedure as contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Hon’ble Supreme Court in Arnesh Kumar v.State of Bihar (2014) 8 SCC 273, in so far as the petitioners/Accused Nos.1 and 2 are concerned. Miscellaneous applications, pending if any, shall stand closed.
