Taken up through video conferencing.
Repeatedly called out. No one appears for the petitioner. On the previous occasion on 24.08.2021 as well as prior thereto on 09.08.2021, also, no one had appeared.
An application being I.A. No. 5339 of 2021 has been filed for seeking legal aid. We have perused the record. The District Commission vide its Order dated 30.09.2014 had dismissed the complaint. The State Commission vide its Order dated 08.06.2017 had dismissed the appeal. As such this petition has been filed against concurrent findings of the two fora below. It has been filed on 06.10.2020, with reported delay of 1126 days. We see no just or conscionable reason to allow the application for legal aid. We also see no just or conscionable reason to provide further opportunity to the petitioner to argue his case for admission. It bears mention that sittings of this Commission allow for virtual hearings from wherever the litigants are located / residing. Sufficient opportunity has been provided to the petitioner.
In the absence of the petitioner, the petition no. 118 of 2021 is dismissed in default for want of prosecution.
The Registry is requested to send a copy each of this Order to all parties in the petition immediately. The stenographer is also requested to upload this Order on the website of this Commission immediately.
