Judgment
Despite repeated calls, none appears for the petitioner.
The petition is pending since 2019. The matter was then taken up on 31.05.2019 but none appeared for the petitioner and when the matter was taken up on 29.07.2022, again none appeared for the petitioner. Again the matter was taken up on 12.12.2022 but none appeared for the petitioner. The matter was again taken up on 31.03.2023, on that date also, none appeared for the petitioner. On the last date of hearing also, i.e. on 04.05.2023, nobody appeared on behalf of the petitioner.
Today, when the matter has been taken up again situation remains the same, neither the petitioner, nor its learned counsel nor anybody else on behalf of the petitioner.
The instant petition stands dismissed in non-prosecution / default.
However, in the interest of justice, it may be observed that if the petitioner wants to pursue the matter in right earnest with due diligence, it may move appropriate application seeking recall of the Order and restoration of the instant petition in accordance with law.
The Registry is requested to send a copy each of this Order to the parties in the petition, to the learned counsel for the petitioner as well as to the fora below within three days. The stenographer is requested to upload this Order on the website of this Commission within three days.
