The revision petition no. 118 of 2021 was dismissed in default for want of prosecution vide this Commission’s Order dated 04.10.2021. This application, no. 274 of 2021, seeks its restoration.

On 28.12.2021 the application was repeatedly called out. No one appeared.

On 12.01.2022 the application was repeatedly called out. No one appeared.

Today i.e. on 04.03.2022 the application has been repeatedly called out. No one appears.

We have gone through the record. The District Commission vide its Order dated 30.09.2014 had dismissed the complaint. The State Commission vide its Order dated 08.06.2017 had dismissed the appeal. As such the revision petition no. 118 of 2021 was filed apropos concurrent findings of the two fora below, wherein both the fora had dismissed the petitioner’s case. It was filed on 06.10.2020, with reported delay of 1126 days. It was dismissed in default for lack of prosecution vide this Commission’s Order dated 04.10.2021. The said Order is self-contained and self-speaking.

We find no just and conscionable ground to provide further opportunity to the applicant to argue his application for restoration. In the absence of the applicant today, the application no. 274 of 2021 is dismissed in default for lack of prosecution.

The Registry is requested to send a copy each of this Order to the parties in the petition, including specifically the petitioner / applicant, within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
