Judgment
This Comp. App. (AT) No. 160 of 2025 is taken up for early hearing of I.A. No. 3329 of 2026. Ld. Counsel for the Union of India is also present. Considering the submissions, the I.A. No. 3329 of 2026 is allowed and the appeal is taken up for hearing.
We have perused the impugned order dated 20.06.2024 which consists of direction to withdraw the application i.e. I.A. No. 931 of 2020. This application was moved by the appellant qua the maintainability of the company petition pending before the Ld. NCLT.
It is the submission of the Ld. Counsel for the appellant now since I.A. No. 931 of 2020 has been finally heard and is reserved for orders, this appeal has become infructuous and be allowed to withdraw this appeal.
We have also heard the Ld. Counsel for Union of India.
Considering the submissions, the appeal stands dismissed as withdrawn. Pending I.A Nos. 4012, 4013, 4014, 4015 of 2025 & 3329 of 2026 are also disposed of.
We make it clear the impugned order which directs the withdrawal of application I.A. No. 931 of 2020 shall not come in the way in deciding the said application I.A. No. 931 of 2020.
