The applicants herein filed OA No.4676/2015 complaining that the respondents with whom they are employed, are not paying them salary regularly.

The plea of the respondents was that the Government of NCT was not releasing the funds and as a result, it was not in a position to pay the salary regularly. It is also stated that as and when the funds are released, salaries are being paid.

The OA was disposed of on 02.05.2016 directing the respondents to pay salary to the applicants on regular basis. This contempt case is filed alleging that the respondents are not paying the salary to the applicants on regular basis.

We heard Shri Sudarshan Rajan, learned counsel for the applicants and Shri Kumar Rajesh Singh, Shri Rajesh Katyal, Shri R.V. Sinha and Ms. Asiya for Ms. Rashmi Chopra, learned counsel for the respondents.

This contempt case is pending for the past three years. Non payment of salary or the delay in payment thereof by the respondents' Corporation has become a general phenomenon. On account of the some hurdles in free flow of funds to the MCD, the delay occurred in payment of the amounts. As of now, the matter is seized by the Hon'ble Delhi High Court and it is being monitored on regular basis. In a recent order dated 05.02.2019, it is observed that a sum of Rs.1104.48 crores was released to the East and North Delhi Municipal Corporations. The priority in which the salaries must be paid was also indicated. The applicants do not deny that ever since the contempt case was filed, salaries were being paid, though not so regularly.

Now, that the matter is being monitored by the Hon'ble Delhi High Court, we do not find it appropriate to continue the contempt proceedings. This Contempt Petition is accordingly closed.

All the pending MAs shall stand disposed of. There shall be no order as to costs.
