Learned Senior Advocate Mr B. B. Naik appearing with learned advocate Mr. Viral M.Pandya for the petitioners states that in view of the fact that the respondent – Bank has waived the additional demand made by the Bank after One Time Settlement was arrived at between the parties.
Learned advocate Mr. Vijaykumar T. Rami appearing for the respondent – Bank places on record an e-mail dated 05.10.2023 addressed to him by the respondent – Bank stating that the time line for extension is extended upto 30.10.2023.
In view of the aforesaid statement made by learned Senior Advocate Mr. Naik as well as considering the e-mail placed on record by learned advocate Mr. Rami appearing for the respondent – Bank, learned Senior Advocate Mr. Naik for the petitioners seeks permission to withdraw this petition at this stage and prays that liberty may be reserved in favour of the petitioners to file a fresh petition, in case of difficulty.
Permission as prayed for is granted.
The present petition stands disposed of as withdrawn at this stage. Notice is discharged. No order as to costs.
