Judgment
Learned Counsel appearing on behalf of Appellant submits that the parties have settled the matter and for this purpose the Appellant has filed an Application - I.A. No. 1792 of 2021. He also submits that the Settlement Application is supported by Affidavit and Settlement Agreement signed by the parties has also been filed along with the Application. Therefore, in the light of settlement the Appellant may be permitted to withdraw the Appeal.
Learned Counsel for Respondent Nos. 1 & 2 is in agreement with the aforesaid submission.
As the parties have already settled the matter, therefore, we permit the Appellant to withdraw Company Appeal(AT) No. 77 of 2020 which is arising out of Company Petition No. 137/241-242 of 2019.
Learned Counsel for the Applicant, who is Respondent in the Appeal, submits that the Applicant may be permitted to withdraw the Contempt Application.
As the parties have settled the matter and we have permitted to withdraw Company Appeal(AT) No. 77 of 2020, therefore we also permit to withdraw the Contempt Application filed by the Respondents. With the aforesaid, Company Appeal(AT) No. 77 of 2020 and Contempt Case (AT) No. 14 of 2020 are dismissed as withdrawn.
The parties shall bear their own costs.
